We don't have minimums, we can create as few as 1 piece.

What part of the bottle can be customized?

You can customize the front part of the bottle with your design.

Is there any coverage if my bottle gets damaged or breaks during shipping?

Tequila Design includes shipping damage insurance. *It is important to document any damages in order to replace your bottle.

How can I design my own tequila?

Let your imagination run wild, you can add people, landscapes, pets, art, products, logos, etc.

Can I use all the palette colors in my design?

You can use all colors except metallic and neon.

Is there an extra cost if my design exceeds a certain number of people?

Yes, there is an extra cost if you exceed 8 people.

Can I use 2 different images for my design?

You can use 2 similar quality images, but you must consult it with the sales team.

Can I buy the bottles empty or fill them with my own Tequila?

We are a Tequila brand, our bottles are already filled with our product.

Can we remove or rearrange the Tequila Design logo?

Due to company policies, we cannot modify the logo.

Does the price change for wholesale or corporate orders?

Yes, we do offer a special price starting with 51 pieces or more.

These Terms and Conditions of Use (the "Terms and Conditions") govern the use of the Tequila Design LLC website ([http://www.tequiladesign.com](http://www.tequiladesign.com/) and https://us.tequiladesign.com/) including, among others, the homepage and all other pages under the same top-level domain name, and all of its content (the "Site") as provided by Tequila Design, LLC (hereinafter "Tequila DSGN®️" or "We"). We may change the Terms and Conditions from time to time and at any time without prior notice by posting such changes on the Site. If you do not agree with any change, you must cease using the Site. PLEASE READ THESE TERMS AND CONDITIONS OF USE CAREFULLY BEFORE USING THIS WEBSITE. BY USING THE SITE, YOU AGREE TO THE TERMS AND CONDITIONS AND THE PRIVACY POLICY INCORPORATED BY REFERENCE AS IT APPLIES TO YOUR USE OF THE SITE. Our Services:

Tequila Design provides a Site to assist consumers in customizing bottles with original designs, which are sent to Passion Spirits LLC, who are responsible for processing all design and customization orders placed on our site. Passion Spirits LLC (hereinafter "Passion Spirits") is considered a marketplace that connects customer orders with Retailers to engage in the sale, service, and delivery of alcoholic beverage products (the "Products") by the Retailers. All orders placed are reviewed, accepted, and ultimately fulfilled by authorized alcoholic beverage retailers (the "Retailer(s)"). Tequila DSGN®️ and Passion Spirits do not provide or sell alcoholic beverages or transport alcoholic beverages and are not an authorized retailer or carrier of alcoholic beverages. Passion Spirits assists you in order fulfillment through retailers in the United States of America. The Products will be sent directly to you by a Retailer, not by Tequila DSGN®️ or Passion Spirits. All orders are processed through the authorized retailer network of Passion Spirits.

Shipping and Delivery Restrictions:

We reserve the right to request proof of identity before assisting you with your purchase through a retailer. The Retailer and their common carrier, if applicable, will require the signature of an adult with age verification at the time of delivery. Retailers do not ship to P.O. boxes.

Shipping and Delivery Policy:

Orders placed are expected to be shipped within four (4) business days once the design is authorized, although we will make every effort to request the retailer to ship your order earlier. If you require assistance with a next-day order or for your order to be shipped the same day, please contact Passion Spirits before placing the order by email at [contact@passionspirits.com](mailto:contact@passionspirits.com) or by phone: toll-free number 1-844-254-6832, phone +1 (305) 531-4311, phone +1-786-768-2980. Retailers generally ship via various courier services such as UPS or FedEx. These companies will email you a tracking number upon pickup from the retailer. Due to Federal Aviation Administration regulations, retailers cannot offer next-day shipping for products containing 70% ABV or higher. In times of inclement weather, including extreme heat or cold, we recommend overnight shipping to reduce transit time or postpone it until conditions improve. The buyer assumes all responsibility for wines/liquors damaged in transit due to weather. Retailers generally do not ship on weekends or government holidays, although they may process orders in the evenings and on weekends. If you receive a "Shipment Confirmation" email after 5 p.m. EST on a weekend or holiday, it means the retailer processed and packaged your order; however, the courier service will send it out on the next business day. Once the purchase of the Products from a Retailer is made, you assume title and ownership of the wines/spirits. By arranging for transportation, the retailer provides you with a service and acts on your behalf. You are solely responsible for determining the legality and tax consequences of shipping wines or spirits.

Shipping Regulations/Restrictions:

Certain states prohibit the direct import of alcohol from other states. Orders placed for addresses within those states may be canceled, and a full refund will be issued. It is your responsibility to know if you can receive shipments from out-of-state retailers. Tequila DSGN®️ / Passion Spirits do not represent any law, rule, or regulation related to the sale, service, transportation, or delivery of alcoholic beverages. Tequila DSGN®️ / Passion Spirits are not responsible for any loss or damage arising from your breach of the terms set forth in these Terms and Conditions or compliance with applicable laws. All orders over $500, where billing and shipping addresses do not match, including gift purchases, will require additional time for credit card authorization. Orders paid by electronic check or PayPal will be shipped once funds have cleared. International customers purchasing gifts for friends and family within the United States must pay through a "confirmed" PayPal account. We cannot accept credit cards for international transactions.

Payments:

Passion Spirits guarantees that your payment, minus fees, will be used to purchase and send the Products from the Retailer to the address you provide.

Refund Policy:

Contact Passion Spirits via email (contact@passionspirits.com) or by phone (toll-free: 1-844-254-6832, W. +1 (305) 531-4311, F. +1-786-768-2980) before attempting a return. All refund requests must be made within twenty (20) days from the date of delivery receipt. Tequila DSGN®️ in conjunction with Passion Spirits will work with the retailer to arrange a return, refund, or credit, but not all retailers in all states accept returns, refunds, or credits. If you suspect a Product is spoiled or defective, reseal the cork on the bottle and contact Passion Spirits. Passion Spirits will communicate with the retailer and inform you of the next steps. There are no refunds for empty bottles. Spoiled or defective Products can generally be exchanged only for an item of equal or lesser value. If the retailer sent you the incorrect Product, contact Passion Spirits immediately to coordinate a replacement through the retailer.

Price List/Typographical Errors:

In the event a Product is listed with an incorrect price, as determined by Tequila DSGN®️ / Passion Spirits in their sole discretion, we reserve the right to refuse or cancel any order placed for the Product listed with the incorrect price, whether or not the order has been confirmed and your credit card charged. If your purchase has already been charged to your credit card and your order is canceled, we will issue a credit to your credit card account for the amount paid.

Disclaimer of Warranty:

THE SITE, INCLUDING WITHOUT LIMITATION ALL CONTENT, FUNCTIONS, AND MATERIALS, IS PROVIDED "AS IS," WITHOUT WARRANTY OF ANY KIND, WHETHER EXPRESS OR IMPLIED, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, any warranty of information, data, uninterrupted access, availability, accuracy, completeness, timeliness, usefulness, content, title, non-infringement, that defects will be corrected, or that the Site or the server that makes the Site available are free of viruses or other harmful components. Some states do not allow limitations or exclusions of warranties, so the above limitations may not apply to certain users. No advice, result or information, whether oral or written, obtained by you from Tequila DSGN®️ / Passion Spirits or through the Site shall create any warranty not expressly stated herein. If you are not satisfied with the Site, your sole remedy is to discontinue use of the Site.

Limitation of Liability:

IN NO EVENT SHALL TEQUILA DSGN®️ OR ANY OF ITS DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING OUT OF OR DIRECTLY OR INDIRECTLY RELATED TO THE USE OR INABILITY TO USE, THE SITE or the related content, materials, and functions, including, but not limited to, loss of revenue or anticipated profits or lost business or sales, even if Tequila DSGN®️ or such individuals have been advised of the possibility of such damages. Some jurisdictions do not allow the limitation or exclusion of liability for incidental or consequential damages, so some of the above limitations may not apply to certain users. In no event shall Tequila DSGN®️ / Passion Spirits be liable for or in connection with any content posted, transmitted, exchanged, or received by or on behalf of any user or other person on or through the Site. Persons who choose to access this Site from other locations do so on their own initiative and are responsible for compliance with local laws, to the extent applicable. These Terms and Conditions, the use of the Site, and the relationship between you and Tequila DSGN®️ shall be governed by the laws of the State of Florida, without regard to its conflict of law provisions. You and Tequila DSGN®️ agree that any cause of action that may arise under this agreement shall be initiated and heard in the appropriate court in the state of Florida. You and Tequila DSGN®️ agree to submit to the personal and exclusive jurisdiction of the courts located in Miami-Dade County in the state of Florida. The fact that Tequila DSGN®️ does not exercise or enforce any right or provision of the Terms and Conditions shall not constitute a waiver of such right or provision. You agree that you are solely responsible for the use or rights to the images, logos, illustrations of any kind provided to Tequila DSGN®️ for any design or illustration request. Tequila DSGN®️ interprets solely based on the design provided by you. You also authorize Tequila DSGN®️ to use said image, logo, or illustration for social media posts and advertising campaigns. We do not review, and cannot review, all the communications and materials posted or created by users accessing the Site, and we are in no way responsible for the content of these communications and materials. You acknowledge that by providing the ability to view and distribute user-generated content on the Site, we are merely acting as a passive conduit for such distribution and are not assuming any obligation or liability relating to any contents or activities on the Site. However, we reserve the right to block or remove communications or materials that we determine to be: (a) abusive, defamatory, or obscene; (b) fraudulent, deceptive, or misleading; (c) in violation of a copyright, trademark, or other intellectual property right of another; or (d) offensive or otherwise unacceptable to Tequila DSGN®️ at its sole discretion.
